Privacy Notice

1. Introduction

This Privacy Notice (“Privacy Notice”) explains how NEC Corporation India Private Limited, a company incorporated under the Companies Act, 1956, bearing CIN No. U72300DL2006FTC151472 and having its registered office at A-31, 1st Floor, Lajpat Nagar Part II, New Delhi – 110024 (hereinafter referred to as “NECI”, “we”, “us”, or “our”), acting as a Data Fiduciary, processes Personal Data collected through its official website (“Website”) and through its official communication channels, including mechanisms for Data Principal Rights, grievances, and other requests.

This Privacy Notice applies specifically to Personal Data processed in connection with:

  • (i)
    Your use of our Website, including submission of enquiries, requests, or communications;
  • (ii)
    Contacting us through official communication channels, including email;
  • (iii)
    Submission of grievance requests, Data Principal Rights (“DSR”) requests, or withdrawal of consent requests (where applicable) through designated mechanisms.

NECI is committed to processing Personal Data in a lawful, fair, and transparent manner in accordance with the provisions of the Digital Personal Data Protection Act, 2023 (“DPDP Act”), and the rules framed thereunder, as amended from time to time.

All capitalized terms used but not defined herein shall have the meaning assigned to them under the DPDP Act.

2. Categories of Personal Data We Process

When you submit a query, request, or communication through our website or official channels, NECI may collect and process the following categories of Personal Data:

    Identification Information – such as your full name;
  • (ii)
    Contact Information – such as email address, phone number, and postal address;
  • (iii)
    Professional Information – such as company/organization name, job title, industry, or business segment;
  • (iv)
    Communication Information – including the contents of your enquiry, message, grievance, or request;
  • (v)
    Information submitted for grievance redressal, Data Principal rights requests, or withdrawal of consent (where applicable);
  • (vi)
    Any additional information voluntarily provided by you.

NECI may also automatically collect limited technical and usage-related information necessary for Website functionality, security, and system administration, including:

    IP address;
  • ii.
    Browser type and version;
  • iii.
    Operating system;
  • iv.
    Device type and identifiers;
  • v.
    Domain name;
  • vi.
    Date and time of access;
  • vii.
    Pages visited and duration of visits;
  • viii.

Such information may be processed independently or in combination with publicly available data or data otherwise lawfully held by NECI for legitimate business, administrative, and security purposes.

Please Note: Our website and services are not directed at children and therefore NECI does not knowingly process Personal Data of children. For the purposes of this Privacy Notice, a child means an individual who has not completed 18 years of age, in accordance with the DPDP Act.

3. Purpose and Lawful Basis of Processing

NECI processes Personal Data only for lawful purposes and in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and other applicable laws. The lawful basis and corresponding purposes of processing are described below.

(a) Consent

Where required under applicable law, NECI processes Personal Data based on your consent. This includes situations where you voluntarily provide Personal Data for a specific, explicit, and lawful purpose, and where consent is considered an appropriate lawful basis under the DPDP Act.

Certain processing activities may require separate or additional consent under applicable law. In such cases, NECI may provide a specific consent notice, form, or mechanism at the relevant stage of the interaction before processing Personal Data for such specific purposes.

Where processing is based on consent, you may withdraw your consent in accordance with applicable law and through the mechanisms made available by NECI. Withdrawal of consent shall not affect the lawfulness of processing carried out prior to such withdrawal.

(b) Certain Legitimate Uses under the DPDP Act

NECI may process Personal Data without obtaining separate consent where such processing is permitted under the “certain legitimate uses” provisions of the DPDP Act. Such processing is carried out only where NECI has assessed that it is reasonably necessary for the stated purpose and permitted under applicable law, including where processing is necessary for the following purposes:

  • Responding to enquiries, requests, or communications initiated by you;
  • Providing customer support and maintaining necessary business communications related to contracted or pre‑contractual interactions;
  • Handling grievances, complaints, Data Principal rights requests, or withdrawal of consent requests;
  • Ensuring the security, availability, integrity, and resilience of NECI’s websites, systems, networks, and services against reasonably foreseeable threats;
  • Preventing, detecting, and investigating fraud, misuse, unauthorized access, cybersecurity incidents, or other unlawful activities;
  • Maintaining internal administrative, governance, audit, risk management, and compliance functions;
  • Complying with applicable legal, statutory, regulatory, contractual, or judicial obligations;
  • Establishing, exercising, or defending legal rights and claims.
In all cases, NECI processes Personal Data only to the extent that such processing is necessary, proportionate, and relevant for the specified purpose, and in accordance with applicable law.

Applications for employment or engagement opportunities may be subject to a separate Recruitment Privacy Notice provided at the time of application.

Marketing or promotional communications, where applicable, constitute a separate processing activity and shall be undertaken only when permitted under applicable law and, where required, based on your consent or applicable communication preferences.

4. Disclosure of Personal Data

NECI may disclose Personal Data to the following categories of recipients strictly for the purposes described in this Privacy Notice and in accordance with applicable law:

  • (i)
    NEC Group Entities: Personal Data may be shared with subsidiaries, affiliates, and group entities of NECI for internal administrative purposes and business operations. Such intra-group transfers are governed by binding contractual arrangements, including intra-group data transfer agreements ensuring appropriate safeguards.
  • (ii)
    Service Providers / Data Processors: NECI may engage third-party service providers (Data Processors) to provide services such as IT infrastructure and support, data analytics, governance, risk, and compliance (GRC) platforms, customer engagement tools, hosting and security services. Processing by such service providers is governed by appropriate data protection agreements requiring Personal Data to be processed only for specified purposes and with suitable technical and organizational safeguards, in accordance with applicable data protection laws.
  • (iii)
    Commercial Partners and Business Transfers: Where relevant, Personal Data may be shared with commercial partners or enterprise customers for legitimate business collaboration purposes. Any such sharing will be undertaken in accordance with applicable law.
  • (iv)
    In the event of a reorganization, merger, acquisition, joint venture, assignment, transfer, slump sale, or any change in control of NECI’s business or assets, Personal Data may be disclosed or transferred to a prospective or actual acquirer or successor entity, subject to appropriate safeguards and compliance with applicable law.
  • (v)
    Legal and Regulatory Authorities: Personal Data may be disclosed to comply with applicable law, statutory obligations, court orders, or lawful governmental requests including in connection with proceedings before the Data Protection Board of India established under the DPDP Act.
  • (vi)
    Cross-Border Transfers: Personal Data may be transferred outside India in accordance with the DPDP Act and any restrictions notified by the Central Government. NECI shall ensure that no transfer is made to jurisdictions restricted by the Government of India and that appropriate safeguards are implemented.

5. Security of Processing

NECI and its recipients apply reasonable security safeguards, including appropriate technical and organisational measures, to protect Personal Data processed in connection with Personal Data under this Notice, having regard to the nature of the Personal Data and the associated risks, in accordance with applicable law.

6. Retention Period

Personal Data collected will be retained only for as long as necessary to fulfil the purposes stated in this Privacy Notice, in accordance with the DPDP Act and the rules made thereunder and NEC’s internal data retention policies, to the extent consistent with applicable law. Thereafter, the Personal Data shall be securely deleted or anonymized in accordance with internal policies and procedures.

7. Cookies

NECI uses cookies and similar technologies on its Website to enable proper functioning, enhance user experience, and collect limited technical and usage-related Personal Data for security, analytics, and Website administration purposes. These technologies help NECI understand how Website is used and improve its services.

8. Exercising Your Rights and Grievance Redressal

In accordance with the DPDP Act, you may request the following:

  • (i)
    Access to information relating to your Personal Data, seek correction/completion/update, or erasure of such Personal Data.
  • (ii)
    You may nominate another individual to exercise these rights on your behalf.
  • (iii)
    Where applicable under law, withdraw your previously provided consent for processing your Personal Data by submitting a written request to NECI.

The exercise of these rights is subject to applicable law and NECI’s internal policies.

9. Amendments to this Privacy Notice

NECI may update or amend this Privacy Notice from time to time to reflect changes in legal or regulatory requirements, or changes in NECI’s data processing practices. The updated Privacy Notice will be published on the Website with the revised effective date.
